Why does GoCertius have legal effect throughout the EU?
A qualified time stamp has legal effect throughout the EU because it is regulated by the EU legislation on electronic trust services, which establishes a common framework for interoperability of electronic trust services in the EU.
Law 6/2020 on electronic trust services for electronic transactions in the internal market, which incorporates EU legislation on trust services into Spanish law, lays down the requirements that qualified time stamp services must meet to be recognized and used throughout the EU.
To be recognized throughout the EU, a qualified time stamp must, among other requirements:
- Be issued by a qualified trust service provider in accordance with the EU regulations
- Meet the technical and legal requirements laid down by the EU regulations
- Be interoperable with other EU electronic trust services
In addition, the EU regulations establish that qualified time stamps issued in an EU Member State must be recognized and may be used in all other EU Member States, which guarantees their legal effect throughout the EU.
